Tb-Scout v2.0 Software License Terms and Conditions

Definitions

"The developer" means Tb-Scout v2.0 developer, OE Ospina-Cuervo, aka, OeOc and Ozzie O, a polyglot translator and linguist who also speaks computerese and IT, information architect and technical writer. "The developer" and "we" are terms used interchangeably. "The user" means you, the person using either the software in "basic edition" mode or in "licensed edition" mode, the latter what you get in case you decide to buy a Product License Key. "The software" means Tb-Scout v2.0, the SDL MultiTerm Explorer. "The software" and "the application" are terms used interchangeably.

By accessing or using the software you agree to be bound by these Terms and Conditions. Do not install or use the software until you have read and accepted these Terms and Conditions.

Privacy Notice

The user privacy is important to the developer. Tb-Scout v2.0 does not collect any type of information, including personally identifiable information, from the user. The only information collected is the user’s email address and only if and when the user decides to purchase a product license. When the user generates a "Pre-Order Key" the product continues to be in "basic edition" mode and the email address the user enters is still not shared with the developer. The email address (and name, if provided) is known to the developer only if the user sends the Pre-Order Key in order to receive, upon payment, a Product License Key. That email address, or any personally identifiable information, on the other hand, is never shared with third parties.

When the application is in use it is never connected or directed to any server. The application runs exclusively in the user’s computer, completely disconnected from the outside world. During the registration process, Tb‑Scout v2.0 does not install anything on the user’s computer when the user agrees to the terms in the (current) License Agreement and then presses "Install". The only action performed is no other than to configure the stand-alone application file (with the extension .accde) to work in the user's computer.

In addition, the application does not include ads nor promotes any type of upselling for licensed users. Privacy is guaranteed.

License grants and restrictions

The developer grants the user a personal, limited, non-exclusive, non-transferable license.
The software can be downloaded and used in "basic edition" mode, for a limited period of time as determined by the developer, and the user is under no obligation to buy anything.

A Product License Key must be purchased to unlock the full functionality of the software, so that the user will be able to use the software in "licensed mode". The Product License Key, the equivalent of a one-year subscription, is unique to the user’s PC and it cannot be used anywhere else, including in the same computer under another Windows user.

Once the Product License Key is registered and the full functionality of the software is unlocked, information clearly labeled on the number of license days remaining to use the software (information found in the About box) will be included. The one-year subscription will start on the date the user unlocks the full functionality of the software, not from the date of installation, nor the date when the Pre‑Order Key was generated, nor the date of purchase.

The differences between "basic edition" mode and "licensed edition" mode, in terms of functionality, are summarized in the "Editions and licenses" page of this Help System. This page is one of the items under the header "What you need to know before using Tb-Scout v2.0", in the Home section.

Support

The software comes with complete documentation (Help System or User Guide)  included in electronic format, specifically in the file named TbSv20.chm (which can be delivered to the user upon request or presented in website format with the same content using the URL https://tbscout20.translationist.com). The content of the CHM file can be reached anywhere from within the software by pressing F1 or by opening said file separately. At any time, you may contact the developer via email at tb‑scout @ translationist.com for technical support with questions not answered in this Help System. Replies will only be provided for those email messages that include screenshots and specific questions or comments, although a prompt reply is not guaranteed. Messages that do not include screenshots will be ignored.

Further development of the software in its present form and technology, i.e. Microsoft Access, is not guaranteed either, and this current version 2.0 might be the last version released to the public. At any rate, technical support will always be provided as long as a Product License Key is in effect, in particular, and if there are enough interested users, in general.

Disclaimer of Liability

THE SOFTWARE AND DOCUMENTATION ARE LICENSED "AS IS," AND THE DEVELOPER DISCLAIMS ANY AND ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT AUTHORIZED BY LAW. WITHOUT LIMITATION OF THE FOREGOING, THE DEVELOPER EXPRESSLY DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR FREE OR THAT THE SOFTWARE DOES NOT CONTAIN ANY VIRUSES. YOU ASSUME RESPONSIBILITY FOR SELECTING THE SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS, AND FOR THE RESULTS OBTAINED FROM YOUR USE OF THE SOFTWARE. YOU SHALL BEAR THE ENTIRE RISK AS TO THE QUALITY AND THE PERFORMANCE OF THE SOFTWARE.

In addition, the developer will have no liability to the user if the software in "basic edition" mode is disabled or stops working at any time. On the other hand, the software in "licensed edition" mode (i.e. with all the functionality unlocked) is expected to perform as explained in the present Help System, which comes with the software package, and/or in the tutorial or promotional videos available on the internet.

Furthermore, and to be more specific, the developer disclaims any express or implied warranty of fitness of the software for exploring SDL MultiTerm termbases as follows: a) using basic and extended searches in termbases that contain more or less than 100,000 total terms per language pair, and b) exploring descriptive fields, at all levels of a termbase structure, in termbases that contain more or less 30,000 terms per language pair and several descriptive fields. In other words, functionality is not guaranteed for a corpus of more or less 100,000 terms per language pair for all kinds of searches that do not involve descriptive fields, and for a corpus of more or less 30,000 terms per language pair for searches that involve descriptive fields and dates. These figures may vary depending on the termbase structure with regard to the number of languages, the number of descriptive fields and the number of terms.

These claims, in light of the scope and limitations of the application as explained in the corresponding section of the current Help System. The developer will have no liability on system malfunctions happening by chance or by unforeseen causes, which are dependent on or conditioned by something else, like Microsoft Windows operating system used and its updates or the lack thereof, Microsoft Office version and its updates or the lack thereof, amount of memory, as well as the data being processed (i.e. when using huge termbases), as indicated above, or termbases that might be corrupt or unusable due to misconfiguration, tampering, etc.

 Important: Do not tamper with your system's date; you may cause the application to revert to "basic mode" even after the product has been unlocked with a valid Product License Key. This unwarranted action automatically voids the Product License Key and also waives the right to a refund.

Refund Policy

All sales must be final. There are no refunds.

The mere fact that the user has been able to send a Pre-Order Key demonstrates that the software is functional since this feature is only available when the user has opened, explored, and closed at least three (3) SDL MultiTerm termbases. The latter a circumstance that validates and enforces the policy of no refund. Please ensure you have read and understood the chapter on "Scope and limitations" of the software.

There will also be no refunds if the application fails to meet user's needs due to a lack of understanding by the user of the application functions and capabilities.

However, if and only if, under very special circumstances, the user demonstrates within seven (7) days of purchase,

  • that the product does not work as intended and as it is widely described and explained in this Help System,
  • and further cooperates and provides proof of that, by means of screenshots,
  • in addition to providing other information, exclusively related to the software installed in the user’s computer, as instructed by the developer,

then, there might be a refund minus processing fees and related costs. Yet, before a refund might be issued, the corresponding Product License Key would be deactivated.

Refunds are not guaranteed in most cases, notwithstanding.

Ownership of the software

The developer retains the copyright, title, and ownership of the software and the written materials.

The developer MAY MODIFY these terms at any time. The latest version of the Terms and Conditions will be posted at https://tbscout20.translationist.com/, which is the present Help System as Web Help System. The online version always supersedes the present version.
